ZBA Minutes Dec 3, 2020 – Town Hall and remote via Zoom 5:30 pm

Present were: Pat Leaming, Jon Fagerstrom, Kevin Moore, Paul Vandal and Debra Fagerstrom (clerk)

Meeting opened at 5:36, by Pat and seconded by Kevin.  Reading of minutes.  Pat motioned to accept minutes. Seconded by Jon. All in favor to accept the minutes from November 24, 2020.

Pat explained he had quite a bit of reading with the application and provisional license provided by Webber Road, LLC. Some of the wording wasn’t precise to indicate if they had in fact completed all necessary steps to attain a license and operate a marijuana facility. 

Page 1 of Notice of Prov Lic. Dated October 8, 2020 States provisional license to develop but not operate the proposed marijuana establishment.  Additionally, items 1-4 list additional conditions needed.  What is the current state of these? This states what will happen if they don’t do certain things but we need to make sure that they have in fact done all that is required to go forward.   It says application deemed complete but the applicant must complete additional requirements. We need to know that those have been done and license is granted.  

Pat motions for a letter from the Cannabis Commission stating specifically that Webber Road, LLC can move forward with opening a marijuana store.  Kevin seconded this motion.  All in favor.  Second motion made by Pat for more clarification on what the provisional license includes and does not include. Need a guarantee from CC that they can move forward with the town of Brimfield. Seconded by Kevin.  All in favor. 

Section 5.1 of Zoning Bylaws – Needs odor control technology for repackaging.  At last meeting, it was discussed that they would be repackaging bulk orders into smaller amounts.  Kevin mentioned needing clarification of what they plan to do to mitigate odors during repackaging.  Pat motioned that under section 5.1, we need to know what odor control technology are they going to be installing to mitigate odors when repackaging. Kevin seconded.  All in favor.

Landscaping – Visual Impact. Pat motioned to ask for details of what types of landscaping they will provide that is conducive to the area.  Section 5.4 under visual impact.  Kevin seconded.  All in favor.

Traffic Impact Statement Sec 7.7 – Pat motioned that a traffic plan statement in more detail from DOT is needed.  Needs to be from Mass DOT, route 20 is a state road.  Kevin seconded.  All in favor.

Vehicle trip table – Need Webber Rd, LLC to explain where traffic is going to be – also needs clarification that you open at 10 am since it shows both 9 and 10. 

Parking – Pat refers to Jon to review parking lot and spaces. There are 11 parking spaces, how will shift changes not create a nuisance.  Kevin notes that they are supposed to fill the islands (part of landscaping)

Energy Use/Conservation – Pat made a Motion for a need to submit energy plan under section 7.5  Will also need to be sent to Building Dept– Kevin seconded.  Paul Vandal will review energy plan when received before any special permit is granted.  Jon will look at ground, parking and land plans.  Kevin will look at construction.  All in favor.

Pat mentioned that the public info session during the summer was not announced properly as even the ZBA wasn’t told.  After we get all the answers, we need to make sure that public notice is given properly in regards to a hearing.

A reply came from Suzanne Collins, ZBA's liasion with the Board of Selectmen, in which the ZBA asked for their support in using their own budget to purchase a printer. Suzanne stated the BOS said ZBA does not need any authority from the Board of Selectmen to use its own budget.  Motion for Deb to continue looking for printer keeping budget around $600.  Printing 11x17 plans in color will help the board accurately read plans. Also, Deb has been using her personal black/white printer/scanner for printing/scanning of ZBA documents but cannot do so in color or larger than 8.5x11. Kevin seconded.  All in favor.
